Teva MedInfo Chatbot – Terms of Use

1. Agreement

By accessing this Chatbot and interacting with it, you agree to these terms and conditions with Teva regarding the use of the Chat Bot and its content, including its responses (“Terms of Use”). These Terms of Use constitute an agreement between you and Teva. You should not proceed to use the Chatbot if you do not agree to these Terms of Use (including, without limitation, the Disclaimers below). In these Terms of Use, “Teva” means Teva Pharmaceutical Industries Ltd (incorporated in Israel) and its affiliates, including its affiliate in the country of the website on which this Chatbot is made available.

2. Purpose and Scope

The Chatbot has been created by Teva to provide general guidance and assistance to standard medical information related queries in relation to the specific Teva medicinal product identified in the Chatbot, based on the approved product leaflets (such as Product Information (PI) leaflets, Consumer Medicine Information (CMI) leaflets or their equivalent) (“Approved Materials”). The answers provided by the Chatbot are solely intended to facilitate review of the Approved Materials of the relevant Teva medicinal product and DO NOT REPLACE THE NEED FOR DETAILED REVIEW OF THE FULL CONTENT OF APPROVED MATERIALS NOR THE ADVICE OF A HEALTHCARE PROFESSIONAL (such as a doctor or pharmacist). This Chatbot DOES NOT PROVIDE ANSWERS TO MEDICAL INQUIRIES, medical advice, diagnosis, prescription, medical treatment, or prescriptions, nor is it a substitute for advice obtained from a physician.

Whilst efforts has been made to ensure that information provided by the Chatbot is accurate and free from errors, to the extent permitted by law, Teva makes no representations, warranties or guarantees in relation to the suitability, continuity, reliability, accuracy, security and completeness of the content. The information provided is for general guidance only and is not intended to be comprehensive, nor to constitute medical advice nor recommendations.  To the extent permitted by law, we will not be liable if this Chatbot (or any information made available through it) is incomplete, corrupted, inaccurate, outdated or incorrect, or is unavailable for any reason. In the event of a conflict between the responses in the Chatbot and the Approved Materials, the Approved Materials should be given precedence.

This Chatbot is not monitored in real-time. It should not be used in cases of medical emergency and does not support emergency calls. In cases of medical emergency, call the emergency number in your country immediately. Never disregard professional medical advice nor delay in seeking or providing medical help because of something you read in this Chatbot.

The Chatbot uses artificial intelligence (AI) technology. Its responses will be based on an automated analysis of the question and a selection of answers to determine the most appropriate one for each query. AI-generated content can be incorrect.

7. Intellectual Property

All rights and content, including copyright, in this Chatbot are owned by or licensed to Teva. Any use of the copyright content not expressly permitted by these Terms of Use is a breach and may violate copyright, trademark or other laws. We expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and all other materials, which appear on this Chatbot. Access to this Chatbot does not confer, and shall not be considered as conferring, any licence under any intellectual property rights in or to this Chatbot or its content.

8. Cybersecurity

We implement reasonable measures to protect our systems and data from unauthorised access, misuse or cyber threats. While we strive to maintain a secure environment, no system is completely immune to risks. By using the Chatbot, you acknowledge and accept the inherent risks associated with internet-based communications. You agree not to attempt to breach, test, nor interfere with the security of our systems or the Chatbot.

9. Privacy

To use this Chatbot, we do not require nor ask you to provide any personally identifiable information (such as your name, age, medical condition, etc.) (“Personal Information”). Teva recommends that you do not provide Personal Information in the Chatbot, and it will not affect the responses. If you choose to provide Personal Information, you consent to us collecting, holding, using and disclosing that Personal Information in accordance with the terms of the “Consent” that you agreed to when entering the Chatbot and the Teva Privacy Notice. Teva will process any Personal Information for the purposes of responding to your request through the automated responses in the Chatbot. Teva will also share any Personal Information with its affiliates and its Service Provider based in the European Union, for the purposes of hosting and managing the Chatbot and complying with applicable legal obligations on Teva’s behalf. Any Personal Information you choose to provide in the Chatbot will be promptly deleted where practicable, unless Teva is legally required to keep it.

We may provide links to other websites operated by third parties. Those links are provided for convenience only, and we are not responsible for their use, effect nor content. 

11. Changes to Terms of Use

We may update these Terms of Use at any time. Continued use of the Chatbot after such changes constitutes acceptance of the new updated terms.

12. Severability

If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, it will be severed to the extent that it is void or unenforceable. The validity and enforceability of the remaining provisions will not be affected.

13. Jurisdiction

These Terms of Use and your use of the Chatbot are subject to the laws and jurisdiction of the country of the website on which Teva made this Chatbot available.
